The consent condition nobody mentions at settlement
There is one trap in Flat Bush that catches more owners than anywhere else we work, and it is worth checking before you book anything. Where a subdivision or development consent required specific trees to be planted or retained as a condition of approval, that condition attaches to the land — and it binds every subsequent owner, whether or not it came up when you bought the property.
This is a genuinely different situation from the ordinary rules. A tree can be entirely on your title, unremarkable to look at, obviously too big for the section, not scheduled as notable, not inside any ecological overlay — and still not legally removable, because retaining it was a condition of the consent that created your lot in the first place.
It will not show on the tree and it is not always obvious from a quick look at the title. The place to check is the resource consent documentation for the subdivision and any covenants registered against the property. We look at the council planning overlays as part of quoting, but consent conditions sit outside that and are worth confirming on your side. Five minutes with your solicitor or the consent file is a great deal cheaper than an enforcement notice.

The tree was here when I bought the house. Can I just remove it?
